WimgoWimgoThese Terms and Conditions (“Agreement”) governs the use of the services (“Service”) that are made available by Wimgo (“wimgo.com”, “we” or “us”). These Terms and Conditions represent the whole agreement and understanding between wimgo.com and the individual or entity who subscribes to our service (“Subscriber” or “you”).
PLEASE READ THIS AGREEMENT CAREFULLY. By submitting your application and by your use of the Service, you agree to comply with all of the terms and conditions set out in this Agreement. Wimgo.com may terminate your account at any time, with or without notice, for conduct that is in breach of this Agreement, for conduct that Website.com believes is harmful to its business, or for conduct where the use of the Service is harmful to any other party.
We provide a platform for individuals who access and use the Services (“Users”) to find and communicate with service professionals (“Experts”), including but not limited to contractors, landscapers, lawyers, photographers and others as permitted on the Services.
While we enable Users and Experts to search for information and communicate with one another, we are not responsible for monitoring such information and communications, and we are not a party to transactions that may occur between Users and Experts. in addition, We are not responsible for and we expressly disclaim all liability that may result from information made available by Users or Experts and the conduct of users and experts, whether online or offline. Wimgo does not sponsor, endorse, recommend or approve of any Expert, nor do we make any representations or warranties about the quality, timing or legality of the products or services they provide. Additionally, we cannot and do not represent or warrant that any Expert is licensed, qualified, bonded, insured or capable of performing any product or service, and we make no representations or warranties about the suitability, reliability or accuracy of the products and services they provide.
The Services are not targeted towards, nor intended for use by, anyone under the age of 13. If you are under the age of 18, or age of legal majority under applicable law, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Services, you represent and warrant that you (a) are 13 years of age or older, (b) are a legal resident of the United States, (c) have not been previously suspended or removed from the Services, or engaged in any activity that could result in suspension or removal from the Services, (d) do not have more than one Wimgo account, and (e) have full power and authority to enter into these Terms and in so doing will not violate any other agreement to which you are a party.
In order to access and use certain areas or features of the Services, you will need to register for an Wimgo account. By creating an account, you agree to (a) provide accurate, current and complete account information, (b) maintain and promptly update your account information as necessary, (c) maintain the security of your password and accept all risks of unauthorized access to your account and the information you provide to us, and (d) immediately notify us if you discover or otherwise suspect any security breaches related to the Services or your account.
Unless otherwise indicated by us, the Services and all content and other materials contained therein, including, without limitation, the Wimgo logo and all designs, text, graphics, pictures, information, data, software, sound files, User Content (as defined in Section 10), other files and the selection and arrangement thereof (collectively, “Wimgo Content”) are the proprietary property of Wimgo , our licensors or users, as applicable, and are protected by U.S. and international copyright laws. The term Wimgo Content, as used in these Terms, does not include third-party trademarks, intellectual property or other content or material owned by third parties and not covered under a license with Wimgo or materials that are in the public domain.
You are hereby granted a limited, nonexclusive, nontransferable, non-sublicensable license to access and use the Services and Wimgo Content. However, such license is subject to these Terms and does not include: (a) any resale or commercial use of the Services or the Wimgo Content therein; provided, however, that Experts are permitted to use the Services for commercial purposes; (b) the collection and use of any product or service listings, pictures, or descriptions; (c) the distribution, public performance or public display of any Wimgo Content; (d) modifying or otherwise making any derivative uses of the Services or the Wimgo Content or any portion thereof; (e) use of any data mining, robots or similar data gathering or extraction methods; (f) downloading (other than the page caching) of any portion of the Services, the Wimgo Content or any information contained therein, except as expressly permitted on the Services; and (g) any use of the Services or the Wimgo Content other than for their intended purposes. Any use of the Services or Wimgo Content other than as specifically authorized herein, without our prior written permission, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws, including, without limitation, copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated by us, nothing in these Terms shall be construed as conferring any right or license to any patent, trademark, copyright or other proprietary rights of Wimgo or any third party, whether by estoppel, implication or otherwise. This license is revocable at any time.
Notwithstanding anything to the contrary in these Terms, the Services and Wimgo Content may include software components provided by Wimgo or a third party that are subject to separate license terms, in which case those license terms will govern such software components.
